I googled to find out where it happened and it was in California. At first, I wondered whether it was in less religious Canada.
Surrogacy is a recent phenomenon, and for various reasons laws haven’t yet been created to responsibly manage it.
Imo, a good idea would be to list a biological parent as a parent on birth certificate, while the second parent in the couple would receive papers and rights as an adopting parent.
Cases in which both an egg and a sperm are from donors should be outlawed. If somebody wants to raise a biologically unrelated child, one may adopt.
Don’t know what happened to the actress, but aren’t biological parents legally responsible for their kids, no matter whether the kids were born by the woman or via a surrogate?

The parents should be legally bound to take care of any children whom they create through surrogacy, but rich couples in first-world countries often arrange to impregnate poor girls in third-world countries as surrogate mothers. Then if the couple decides to reject the resulting child as unacceptable for any reason (such as Down’s syndrome), there are currently no laws that can reach around the world to hold the parents accountable.
It’s beyond disgusting, but that’s how it is today.
