So the ultra-super-duper-necessary FBI investigation uncovered absolutely nothing – how shocking. And so now the leading objection is that his “temperament” is all wrong.

And once again, as somebody whose temperament is very Ukrainian, I find this kind of objection threatening to me. I don’t ever want the argument that I’m too temperamental to hold a job to be advanced against me. And since it’s too late for me to acquire the temperament of a shrinking violet, I prefer for such arguments to not exist.

    It’s: appearance of impropriety, partiality, bias, putting emotions and personal beliefs and concerns above law, etc. It’s in the US code of conduct for judges, which emphasizes the special situation of judges.

    “An appearance of impropriety occurs when reasonable minds, with knowledge of all the relevant circumstances disclosed by a reasonable inquiry, would conclude that the judge’s honesty, integrity, impartiality, temperament, or fitness to serve as a judge is impaired. Public confidence in the judiciary is eroded by irresponsible or improper conduct by judges. A judge must avoid all impropriety and appearance of impropriety. This prohibition applies to both professional and personal conduct. A judge must expect to be the subject of constant public scrutiny and accept freely and willingly restrictions that might be viewed as burdensome by the ordinary citizen.”

      Our situation is a lot more special. We work with kids, we are mandated reporters. “How can she teach kids and be a mandated reporter if she drank, has or had a disordered personal life, got married 4 times, is too emotional? Protect the kids! Kids are not safe!”

      This is not a fantasy. I have a colleague who was persecuted with precisely this argument. She’s loud, she’s obnoxious, she sticks up for everybody’s rights, something must be wrong with her.

      Then it was another colleague. She’s 60 and she’s never been married, she’s abrasive, something must be wrong with her, she must be a sexual predator. Not a whiff of an allegation, not an iota of proof. But hey, who cares? The job market is oversaturated, there are more where this one came from. This is happening before my eyes. These are good people I know. And they are hounded and rumors are spread over nothing. Because they are opinionated women who spoke out against this or that and it rubbed somebody the wrong way.

        Oh, I’ve always had these problems. And I’ve been accused of having affairs with undergraduates twice, because of having had independent study courses with them. (You actually met one of them, wouldn’t you say he seemed more like a son than my boyfriend? The other one seems more like a younger brother.) I deal with all kinds of discrimination. I have done for a long time. It’s not new, it’s not caused by neoliberalism, and having Kavanaugh on the SC won’t improve it.

    In every job interview, the candidate temperament is scrutinized. Nothing new here.

      In every interview where a candidate is accused with zero proof of gang rape, you mean?

      He was confirmed 5 minutes ago, by the way.

        I have personaly no problem to confirm him, but if you’re hysterical during your job interview, recruiters almost all don’t like it.

          Recruiters, with all of their numerous problems, don’t tend to accuse people of gang rape based on absolutely no evidence whatsoever.

          I can’t imagine any normal person react any differently to such horrific accusations.
