Ohio voters approved a ballot measure Tuesday night that will effectively outlaw any restrictions on abortion and other procedures that involve reproduction, including gender-transition surgeries. The measure, known as Issue 1, will also remove parental-consent and notification requirements for minors who undergo the procedures. . . The amendment was written by the ACLU, which has spent years fighting to remove parental involvement from abortion and gender-transition procedures. . . Ohio voters also approved a ballot measure to legalize the sale of marijuana to people 21 and over, and permit growing the plant as a cash crop.

Good job, Ohio voters! The dysfunction I saw in Cincinnati last week is clearly very wanted and deserved by you. Keep on this ACLU track and there is no limit to your impoverishment and exploitation.

You are accepting the National Review’s framing of the issue. Below is the actual text that was added to the Ohio Constitution.

Article I, Section 22. The Right to Reproductive Freedom with Protections for Health and Safety

A. Every individual has a right to make and carry out one’s own reproductive decisions, including but not limited to decisions on:

contraception;
fertility treatment;
continuing one’s own pregnancy;
miscarriage care; and
abortion.

B. The State shall not, directly or indirectly, burden, penalize, prohibit, interfere with, or discriminate against either:

An individual’s voluntary exercise of this right or
A person or entity that assists an individual exercising this right,
unless the State demonstrates that it is using the least restrictive means to advance the individual’s health in accordance with widely accepted and evidence-based standards of care.

However, abortion may be prohibited after fetal viability. But in no case may such an abortion be prohibited if in the professional judgment of the pregnant patient’s treating physician it is necessary to protect the pregnant patient’s life or health.

C. As used in this Section:

“Fetal viability” means “the point in a pregnancy when, in the professional judgment of the pregnant patient’s treating physician, the fetus has a significant likelihood of survival outside the uterus with reasonable measures. This is determined on a case-by-case basis.”
“State” includes any governmental entity and any political subdivision.

D. This Section is self-executing

  l think you are not seeing the wood for the trees. The blog post was calling attention to the fact that this liberalising measure is in line with a long streak of policies throughout the USA and the West which support the neoliberal “reason” of the world [Pierre Dardot, Christian Laval, La nouvelle raison néoliberale du monde]. This is what is leading to the loss of liberty through the disguise of total freedom for the individual, as represented by the ACLU-pushed constitutional amendments in Ohio which Clarissa was drawing attention to.

    I love Dardot and Laval. They explained that neoliberalism permeates how we think and feel a long time ago.
    
    The text of the amendment is so neoliberal it’s almost funny.

The good news is that the bit about gender transition is very tenuous. There are no references to gender transition in the constitutional change, the worry is based on the language of “included but not limited to.” In the hands of activist judges this could be a nightmare, but we’re very lucky to have a conservative majority on the Ohio Supreme Court. I am not very worried about this.

The bad news is…everything else. Yesterday was very sad. But not surprising, considering how other abortion ballot measures have gone in various states. After a victory in a state that’s to the right of the median on abortion (both opinion polling and personal experience indicate this), expect abortion advocates to go all out in red states going forward. Sometimes it’s hard to have any hope as far as politics go.

To add insult to injury, local elections in Cincinnati were also quite dismal. We lost the last Republican on city council and we agreed to the stupid, shortsighted railroad sale.
