A Real Threat to the Constitutional Order

In a Friday Times essay, two Ivy League professors declared the “broken” and “famously undemocratic” U.S. Constitution “stands in the way” of “real” freedom and democracy, while issuing a call to “radically alter the basic rules of the game” by no longer requiring us to “justify our politics by the Constitution.”

This is precisely why I can’t take seriously Continetti’s belief that the 1/6 riot represented a serious threat to the constitutional order. The protesters had absolutely no power to do anything but break a few windows. They have no champion, whether an individual politician or a political force, to stand up for them. Trump had two weeks to pardon them and didn’t. The NYTimes isn’t interested in publishing their opinions. They control no institutions and no media of mass communication. They don’t own any global corporations, the FBI doesn’t do their bidding, and nobody gets fired or cancelled for disagreeing with them. The two professors in the linked piece belong to a political movement that does have all of this. And that movement can’t shut up about how much it despises the US Constitution.

So who’s a real threat?

Many people on the Right confuse the constitutional order with rules of politeness. The 1/6 protesters were rude and uncouth. They provoke a class-based disgust but nobody dares to say that, so they invent imaginary threats to the constitutional order to avoid saying, “these people look icky.”

    So is the George Will faction of tactical bowtie straightening and strategic “muh principles” genuflecting.

    For what it’s worth, the Ron DeSantis faction of punking the Left but explaining to the Right isn’t exactly in, but it’s a required thing for Florida.

    It works like this: if you don’t explain certain actions, people in Florida may begin to believe that what you’re doing is an arbitrary extension of power.

    And so Grady Judd down in Polk County has press conferences so he can explain the latest Disney pedo busts (“there’s always one”) as well as how they’re going out of their way to respect Constitutional rights during their endless parade of serious criminals.

    It’s mostly because of Judd that Winter Haven isn’t totally run over with crime, which makes it still functional for visiting tourists, let alone Lakeland.

    DeSantis follows this tradition because Florida has some violent history: do you want to be known as the next Major Dade by whatever group will serve as the Seminoles?

    Given what’s building up, it would be very easy for the Right in Florida’s urban areas to have serious sympathies for the Seminoles and their history.

    You know, it wouldn’t take much in a post-rule of law scenario for Grady Judd to decide that he could look the other way when right wing paramilitary death squads decide they want to turn Lakeland and Winter Haven into Anytown USA by force.

    The 6 January protesters looked like a Lynyrd Skynyrd after-concert party.

    I’m expecting these Poison Ivy Leaguers won’t like it when the tune shifts to “Welcome to the Jungle”.

    1. Sorry, I don’t know why WordPress does this. There’s a commenter who had been posting for years, and every single one of his comments gets stuck in moderation for reasons I haven’t been able to fathom. Even something short and anodyne like “great post” gets moderated if he’s the author. Maybe it’s because his avatar is “Demotrash”, and WordPress’s feelings get hurt.

      Can somebody try posting as “Repuglican” or something to test the fairness of the system?
